As Tunca Antique Company; Buyers (participants) who will participate in the online auctions we organize, accept the following terms in advance.

1- Tunca Antique Company is an intermediary for the Seller and is entitled to a commission at the time of the sale due to its instant intermediary service in electronic environment.

2- All the works offered for sale are T.C. It is controlled by the museum experts of the Ministry of Culture and Tourism, and documents are issued to those within the scope of the law and those deemed necessary.

3- In order to participate in online auctions, it is required to register a member at www.tuncamuzayede.com.

4- The works in the online auctions are sold before the sale, after the online catalog is published, Kuştepe Yolu Tomurcuk Sok. Antikacılar Çarşısı No: 3/52 Mecidiyeköy Şişli Istanbul 34387. All information given for the promotion of the works in the online auction catalog is the opinion of the experts. 5- Participants in the online auction acknowledge and declare that they have previously seen and examined the works at the address of Tunca Antik company specified in Article 4. The buyer accepts and undertakes that all works are offered for sale as they are, the buyer has checked the sold work sufficiently before it takes place and that it waives the provisions specified in Article 223 of the Code of Obligations. There is no obligation to write as it is next to each work. The information given about the work and all kinds of announcements are not in the nature of commitment, but are general information. The buyer accepts this situation in advance. Tunca Antique Company is not obliged to guarantee the work (goods) sold. In this regard, he will not make any objections or demands from Tunca Antik company in the future.

6- In online auctions, the price increase is made by clicking on the place where it says "BID" The buyer is bound by his bid by bidding in the online auction. The item subject to the auction is tendered to the buyer who made the highest bid as of the auction end time determined by the Tunca Antik company. For whatever reason, the buyer cannot refuse the auction. Our company is authorized to determine how much value increase means pressing the BID section in the online auction and to change these values. Increasing the cost of an item placed on Online Auction can be started with less than twenty percent of the estimated value. Guests who do not register for the website and do not receive an "online auction participation password" cannot participate in the online auction. "Online auction participation password" is personal; It is forbidden to use other than the member owner. The online auction participant acknowledges and undertakes that our company will not accept any responsibility for the use of this unique password by other persons. The increase continues by giving bids until the end of the period given for the product, and when the time expires, the person who gives the most money to the product wins the increase.

6.1 - In online auctions held on the website of Tunca Antique Company, while the auction is ongoing, the highest bid for the product subject to the auction will be displayed on the auction screen in its current form. In this context, the participants in the online auction, the bids put forward and by whom, in what amount, the highest bid, etc. The information will be encrypted and secured in our company, and the participants acknowledge and undertake that they do not have the right to object to these records in any way.

6.2 - VAT and intermediary service commission fee (+ VAT) will be added to the prices of the products put on the online auction, and the buyer is responsible for all prices.

7- An invoice is prepared for all purchased works. Invoices are prepared on the computer according to the member number, name, surname and address. However, the invoice given to the customer is issued by Tunca Antique Company due to legal obligation. An invoice does not indicate that the Tunca Antique Company is a seller. Tunca Antique Company is not a seller; It is the intermediary in the sale. The 7% commission + VAT that Tunca Antique Company will be entitled to for its service will be paid separately by the person remaining on the item at the auction. Tunca Antique Company's commission (+ VAT) will be due from the moment the auction ends. Even if the buyer declines to buy the work subject to the tender, he is obliged to pay 7% commission in addition to the penal clause. The service provided by Tunca Antik company in this context; It is an online intermediary service and is not included in the right of withdrawal.

8- The cost of the purchased goods is paid by the buyer by money order or in cash, within 7 days from the day of the auction. As soon as the buyer pays the entire sales price, Value Added Tax (VAT) and 7% auction company commission (+ VAT), Tunca Antik will be obliged to deliver the product. From the payment; Tunca Antik will send / deliver the item to the buyer within 7 days for local deliveries and 14 days for out-of-town deliveries. The buyer is informed by the Tunca Antique Company that the goods have been shipped. Tunca Antik cannot be held responsible for delays caused by the cargo company.

9- The person participating in the tender has no right of withdrawal since the auction to be made is realized in accordance with the regulations in the articles of TBK 274 and the following and cannot be accepted as a distance sales contract regulated in Article 48 of the Consumer Law. If the remaining person does not pay the price of the work in full within 7 days, Tunca Antique Company is authorized to terminate the sales contract, 7% penal clause and all losses incurred with commercial interest and 15% monthly interest from the invoice date. The rights of other lawsuits and claims of Tunca Antik company are reserved. The sold work will not be delivered to the buyer unless the total cost to be made by the Tunca Antik company for the preservation of the work until the invoice price is collected.

10- Notifications made by mail, fax, e-mail or telephone to the open postal address and other contact information specified by the auction participant in the online membership form, inaccuracies in the notifications and product information, change of address, late arrival at the address and delays in the PTT / cargo. Tunca Antik company is not responsible.

11- In cases where the works offered for sale within the scope of the Online Auction do not have the declared qualifications, are not suitable for the declaration as of their origin, or are disposed of without the consent of the right owner, the legal responsibility belongs to the person requesting the offer of the work for sale.

12-Tunca Antik reserves the right to withdraw any work in the auction, to sell it with other works, to separate it from each other and to reject the sale. As a result of any objection and notification that may arise about the works in the online catalog until the auction day, it has the right to not present the relevant work to the auction and to apply the legal procedure.

13-Tunca Antik has the authority not to accept people it deems suspicious as members and not to accept online auctions without any excuse. In addition, the provisions of liability for the seizure in the articles of BK 214 and 218 are not applicable to the company Tunca Antik, as it acts as an intermediary for the seller. Those under 18 cannot be members.

14- It means making an auction and participating in the online auction: it means accepting in advance all of the above-mentioned conditions as well as other rights and obligations of our institution (no objections are made after the sale is made).

15- In case of typos in the Online Catalog, the explanations given by our company are taken as basis.

16- All texts and photographs published in the Online Catalog cannot be published in whole or in part without the written permission of Tunca Antik.

17- The catalog values ​​of the works offered for sale in the Online Auction are not the final values ​​of the works but the starting price of the auction.

18- New laws, changes in laws and changes in tax rates that may come into effect after the Online Catalog is published will be reflected on the buyers, and Tunca Antik will not be held responsible. Online auction

19- Antique objects are delivered only to address Turkey.

20- Pursuant to Article 45 of the Law No. 5846 and the decision of the Council of Ministers dated 27.09.2006 and numbered 2006/10880, in this context, the shares to be paid to the artists or right holders in accordance with the document order, the owners of the works of which will be sold at the auction. The antique company has the right of recourse.

21- Anyone who has registered a member number and who participates in the online auction is deemed to have read and accepted the above conditions in advance.

22- Istanbul Courts and Execution Offices are authorized in disputes arising from the Conditions of Participation in the Auction.

23- The shipping fee of the works you have bought as a result of the auction belongs to the buyer and our company is not responsible for any damage to the work during shipment.

25- Our online auctions will end live on the specified date and at the specified time. When the live auction starts, bids can be given for the work that is put up for sale, but not for the subsequent works.
